Terms of Service

These Terms of Service ("Terms") govern your use of ListedBarber.com and all associated services (the "Platform") operated by Idaman Barber (operating as "BNR", also "we", "our", "us"). ListedBarber and BookAnyBarber are trade names of Idaman Barber. By creating an account, subscribing to a paid tier, or using the Platform in any way, you agree to these Terms.

Plain-language summary: This is the contract between you (the barber) and BNR. It explains how subscriptions, fees, payouts, manual bookings, verification, and account termination work. Read it fully. If you don't agree, don't use the Platform.

1. Who May Use the Platform

You must be at least 18 years old and legally permitted to operate as a licensed barber or cosmetologist in the state where you provide services. You must maintain a current, valid professional license for the entire time your account is active on the Platform. Providing false information about licensing, identity, or state of operation is grounds for immediate termination without refund.

2. Account Creation and Verification

When you sign up, you must provide accurate information including your legal name, email, phone number, shop name, state, and city. We require the following verification steps before your account can accept bookings:

Your account cannot accept bookings until identity and license verification are complete.

3. Subscription Plans and Fees

We offer four tiers. All subscriptions are billed monthly unless you select an annual plan.

We do not offer free trials. If you miss your tier's quota for two consecutive months, your account will be automatically downgraded to the nearest tier you qualify for, or to Free if you qualify for no paid tier. Subscription fees are non-refundable except as required by law.

4. Booking Fees

The Platform charges fees based on the payment method used by the client:

App Bookings (Wallet, Card, Apple Pay, Google Pay, Tap to Pay)

Cash Bookings (Booked Through the App, Paid in Cash at Shop)

Manual Bookings (Walk-Ins and Phone Bookings You Add Yourself)

5. Barber Wallet and Balance

Your barber wallet tracks earnings, fees, and pending payouts. Your balance may go negative if fees exceed available earnings (for example, multiple cash cancellations in a row). A negative balance must be cleared before you can request a payout. The Platform does not charge interest on negative balances, but you are responsible for the debt and must repay it by earning future revenue or by adding funds.

6. Payouts (Stripe Connect)

Payouts are processed through Stripe Connect. You must complete Stripe Connect onboarding to receive payouts. Stripe collects bank account information directly and BNR does not store it. We offer two payout speeds:

Minimum payout is $25.00. Payouts are only available when your balance is positive and meets the minimum. Stripe's processing times and bank availability are outside BNR's control.

7. License Compliance and Renewal

State law requires a current barber or cosmetologist license to legally provide services. We mirror this requirement on the Platform.

8. Stripe Connect Requirement for Card Bookings

To accept card, Apple Pay, Google Pay, or Tap to Pay bookings, you must have Stripe Connect fully onboarded. If you have not completed Stripe Connect, clients attempting card bookings will be blocked. Wallet and cash bookings do not require Stripe Connect.

9. Streak Reward (City Exclusive Only)

If you maintain the $99/month City Exclusive tier with at least 150 completed bookings per calendar month for 12 consecutive months, you earn a $150 credit toward BNR Supply (our barber supply mini-mall). The credit is not cash. It cannot be withdrawn, transferred, or redeemed for monetary value. It is non-transferable and expires 12 months after issue.

10. Cancellation, No-Show, and CQS

BNR maintains an internal reliability signal (the "Client Quality Score" or CQS) used to help the Platform function. The specific inputs, factors, and calculation methods are proprietary and confidential. Barbers see a numeric score; clients see only a badge tier. Barbers can mark bookings as "SHOWED", "NO-SHOW", or cancel. Misuse of these features (for example, falsely marking real clients as no-shows) is prohibited and may result in account suspension.

11. Proprietary Systems and Trade Secrets

The Platform relies on proprietary algorithms, scoring systems, booking priority logic, matching logic, ranking logic, and business rules that constitute trade secrets of BNR. You agree not to reverse-engineer, probe, test, attempt to derive, publicly describe, or reproduce any portion of these systems, including but not limited to the inputs, weights, factors, thresholds, or decisioning used by BNR to operate the Platform. BNR may modify these systems at any time without notice. Nothing in these Terms grants you any right to or interest in BNR's proprietary systems.

14. Affiliate Disclosures (BNR Supply / Mini-Malls)

BNR operates mini-malls that link to third-party retailers including Amazon. BNR is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and linking to Amazon.com. As an Amazon Associate, BNR earns from qualifying purchases. Product availability, pricing, and shipping are controlled by the third-party retailer, not BNR.

15. Termination

You may cancel your subscription at any time from the Plan & Billing section of your dashboard. Cancellation takes effect at the end of your current billing period. Subscription fees already paid are non-refundable. BNR may terminate or suspend your account for any violation of these Terms, non-payment, or regulatory reasons. Termination does not relieve you of any outstanding obligations (including negative wallet balance).

16. Disclaimer of Warranties

The Platform is provided "as is" and "as available". BNR makes no warranties, express or implied, regarding uptime, booking volume, revenue, or business outcomes. You are an independent contractor and not an employee, agent, partner, or joint venture of BNR. You have sole and exclusive control over the means, manner, timing, location, and quality of your professional services. You are solely responsible for: (a) all professional services performed, including quality, safety, and outcomes; (b) compliance with all applicable federal, state, and local laws, licensing requirements, and tax obligations; (c) obtaining and maintaining any required professional liability or business insurance; (d) reporting all income to tax authorities; and (e) any dispute or claim arising from services you provide to clients. BNR is a software platform that connects you with clients. BNR is not a barber service provider, shop, employer, or agent, and has no responsibility for services you perform.

17. Limitation of Liability

To the maximum extent permitted by law, BNR's total liability to you for any claim arising from these Terms or the Platform is limited to the amount you paid BNR in the 12 months immediately preceding the claim. BNR is not liable for indirect, consequential, special, incidental, or punitive damages.

18. Indemnification

You agree to indemnify and hold BNR harmless from any claims, damages, or expenses (including reasonable attorney fees) arising from your use of the Platform, your violation of these Terms, or your violation of any law or third-party rights.

19. Pre-Launch / Beta Status

The Platform is in pre-launch and beta status. Features, pricing, policies, and functionality may change frequently. Beta users acknowledge and accept:

By using the Platform during beta, you acknowledge these conditions and release BNR from claims arising from beta-related changes or issues, except for claims that cannot be waived under applicable law.

20. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Idaho, without regard to conflict of laws principles.

Small claims exception: Either party may bring an individual action in small claims court for disputes under $5,000 USD, provided the court has jurisdiction and the action remains in that court.

Arbitration for larger disputes: Any dispute of $5,000 USD or greater that is not resolved informally within 30 days must be resolved through binding arbitration in Ada County, Idaho, administered by the American Arbitration Association under its Commercial Arbitration Rules. Judgment on any award may be entered in any court of competent jurisdiction.

No class actions: You agree to resolve disputes on an individual basis. Class arbitration, class action, or representative proceedings are not permitted.

21. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted with a new "Last updated" date and may be sent by email or notified in-app. Continued use of the Platform after changes constitutes acceptance.
